Terms

The sales and delivery terms below apply to all distance-selling deliveries from the webshop CarLab.dk, CVR no. 27331939, to private consumers. In the case of sales to companies, dealers, and other business customers (B2B), the relevant provisions under Danish law apply at all times. In the case of trade in a physical store, the applicable rules under Danish law also apply. The terms apply in cases where no other written agreements have been entered into between you as the buyer and CarLab.dk.

Documentation and instructions
If product descriptions and user manuals for the item exist, these are included with the delivery from CarLab.dk. If you want additional information or advice from CarLab.dk´s side, this is of a guiding nature.

Legislation
v.dk points out that some of the goods for sale in the shop are illegal, according to Danish law, to use/have in public places/on roads. These goods are for exhibitions/track driving/driving abroad (not Danish reg.). If you are in doubt, please contact the local police. CarLab.dk cannot be held responsible for any violations/fines.

Delivery time and transport
Delivery of goods from CarLab.dk is considered completed when the consumer has received the item. Shipment of goods takes place by Post or carrier if nothing else has been agreed in advance. Normal delivery time is 1-3 business days. Please note that some items are "not in stock" or specially manufactured; for these items the delivery time may exceed the normal delivery time. On the website, our delivery times are estimated and updated to the best of our belief. Contrary to expectations, delivery times may occur that are longer than described on the website.

Parcels are sent with GLS to the specified delivery address. All parcels are sent as insured goods and with Track & Trace.

If you are not at home at delivery to a private address, the parcel must subsequently be collected from the nearest GLS parcel shop. You will receive further notice from GLS by email and/or SMS.

These terms apply to shipments in Denmark to islands connected by bridge. Separate shipping rates apply for parcels abroad.

The risk for the goods
The risk for goods purchased from CarLab.dk passes to you as the consumer when the item is collected from our address by you, or when you take physical possession of the item.

Complaint
When you shop at CarLab.dk, you of course have a 24-month right to complain. This means that you can either have the item repaired, exchanged, get your money back, or receive a reduction in price, depending on the specific situation. Of course, this requires that the complaint is justified and that the defect has not arisen as a result of incorrect use of the product or other damaging behavior.


Any errors or defects in delivery from CarLab.dk must be claimed within a reasonable time after you have discovered the error. If you complain within two months after the defect is discovered, the complaint will always be timely. It is your duty to state and, on request, show how the error or defect manifests itself. If you discover an error, you must contact CarLab.dk as soon as possible. As a general rule, you can only complain about defects that appear no later than two years after you have received the item. For goods with a limited shelf life or lifespan (e.g. bulbs, neon tubes, etc.), your right to complain is limited to the item's normal lifespan.

If the complaint is justified, we will reimburse your (reasonable) shipping costs. The item must always be returned in proper packaging, and remember to obtain a receipt for dispatch so that we can reimburse your shipping costs. Please note that we do not accept parcels sent cash on delivery or without delivery.

If you wish to complain about your purchase, please contact info@CarLab.dk. If it is not possible to find a solution, you can submit a complaint to the relevant board in the area, provided that the conditions for this are met.

To be able to complain to Nævnenes Hus, the item or service you wish to complain about must have cost at least DKK 1,110 and at most DKK 100,000.

Warranty
CarLab.dk provides no independent warranty. If there is a warranty on the products, it is solely the warranty the manufacturer has offered you. All inquiries regarding warranty must therefore be directed to the product manufacturer.

Age
You must be at least 18 years old to shop at CarLab.dk. By approving the order, the buyer confirms that they are over 18 years old or have parental approval.

Product liability
CarLab.dk is liable for product liability in accordance with the legislation in force at any time, but does not accept liability to any greater extent than provided by law.

Ordering
You can only shop via our website, CarLab.dk, as our warehouse is not located at the address. If you have inquiries about items that are not on the site, you are welcome to contact us by phone or email. When you shop at CarLab.dk, agreements are made in Danish. It is possible to view previous orders by logging in on the website. If you want to receive a copy of your order confirmation, please send an email to kundeservice@carlab.dk.

Price and payment
All prices include VAT and other taxes. Prices are current prices. In case of delays, backorders or sold-out items, we will do our best to inform you as soon as possible and what we can do about it - e.g. refund your money, or help you find a similar item elsewhere. If a price is obviously incorrect and you reasonably should have noticed this, we are not obligated to deliver the product in question at the incorrect price.

A payment/card fee is associated with the use of the different payment options. The fee for using the respective payment cards and methods is stated in parentheses.

If you pay with an international payment card (VISA, MasterCard), the amount is reserved immediately.
The money is reserved on your card or account until:
1) we charge the amount when we send the item, or 
2) the money is released according to the agreement with your card issuer. 

As standard, the money is reserved for 30 days, after which the reservation is automatically canceled. However, you can contact your bank with documentation that the purchase has been canceled, so they can remove the reservation earlier.

Sale on invoice requires approval. We reserve the right not to grant credit or sell on invoice without further explanation.

All prices include VAT. For custom-made products, CarLab.dk reserves the right to require prepayment. CarLab.dk reserves the right to change prices and information without prior notice.

Information about campaigns and sales
The item is only reserved for you when your order has been completed, and payment details have been registered in our system.
Do not wait too long between adding items to your cart and completing your order, as the item you selected may be sold out before you finish your order.

Right of cancellation for online purchases
The cancellation period expires 14 days after the day you:
1/ have received your item
2/ receive the last item in physical possession, in the case of an agreement for several different items that are ordered in one order and delivered individually.
3/ receive the last batch, or the last part, in physical possession, in the case of an agreement for delivery of an item consisting of several batches or parts.
4/ receive the first item in physical possession, in the case of agreements for regular delivery of items over a certain period.

You must notify us within 14 days of receiving the item that you wish to cancel your purchase. The notification must be sent by email to kundeservice@carlab.dk. In your message, you must clearly state that you wish to exercise your right of cancellation; you may also choose to use our standard cancellation form and send it back with the return. You can find it here.

You CANNOT cancel simply by refusing to accept the package. If you choose to do so anyway, you must cover the costs we have associated with returning the item to us. 

The right of cancellation does not apply to custom-made items, such as specially manufactured items made to the customer's specifications, and items that are cut/sold by the meter. These are not taken back and cannot be cancelled, returned, or exchanged once ordered.

Safety equipment with approvals (e.g. TÜV, ISO) must be returned to the manufacturer for testing and repackaging.

Cancellation of part of the purchase
If you have purchased several items from us, you have the option to return one or more items, even if they were purchased under one order. Please note that you will not get the shipping costs back if you cancel part of your purchase. 

If you have received free shipping, a free item, or other discounts conditional on a purchase above a certain value, and this condition is no longer met after returning part of the purchase, the value of the discount, the gift (if it has not been returned), and/or the shipping will be deducted from the amount refunded to you. The shipping amount will usually be 59 kr.

Breaking the seal on products with a seal
Delivery of sealed products, audio or video recordings, or computer software whose seal you have broken cannot be cancelled.

The condition of the item when you return it after cancellation.
You are only liable for any decrease in the value of the item caused by handling other than what is necessary to establish the nature, characteristics, and functioning of the item. In other words, you may try the item in the same way as you would in a physical store.
If the item has been tested beyond what is described above, we consider it used, which means that if you withdraw from the purchase, you will only receive part of or none of the purchase price back, depending on the item’s commercial value.
To receive the full purchase price back, you must do the same as you can in a physical store. You may test/examine the item, but not put it into actual use. Please note that if you break the seal on liquids, car care products and other liquids, this may constitute a reduction in value and in some cases you will only receive 0 DKK back. We therefore encourage you not to break any seals.

Condition of the item and packaging upon return

You are only liable for any decrease in the item’s value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the item.

The item must be returned in its original packaging, including any inserts, manuals, accessories and protective materials, if the original packaging was delivered with the item and is still in the customer’s possession. Original packaging is considered part of the item when it affects the item’s commercial value.

If the original packaging is not available, the item must be returned in other similar, proper packaging that secures the item during transport.

Missing, damaged or inadequate packaging may result in a reduction in value if this affects the item’s ability to be sold as new. Such a reduction in value may be deducted from the amount refunded upon withdrawal.

Your order must be returned to us without undue delay and no later than 14 days after you have informed us that you wish to withdraw from your purchase. You shall bear the direct costs associated with returning the item(s). Due to their size/weight, certain items cannot be returned by regular mail. This applies to heavy and bulky goods, return costs approx. 1000 DKK/pallet. Return parcels sent cash on delivery to CarLab.dk will not be collected.

You are responsible for ensuring that the item reaches us safely, so remember to always pack the item well and we recommend sending it as a parcel with Track & Trace (if the parcel should disappear during transport).
You must include a copy of your invoice when returning an item. We also encourage you as a consumer to complete our standard withdrawal form, which you can find here;

Refund of the purchase amount
If you cancel your purchase, you will receive the amount you have paid to us back, including delivery costs (however, this does not apply to additional delivery costs in cases where you have chosen a different delivery method than the cheapest standard delivery method we offer), within 14 days from the day you notify us of this. If you return individual items from your order, we will refund the price of the item; if you return your entire order, we will refund the price of the item(s) + standard postage. In the event of a decrease in value for which you are liable, this will be deducted from the purchase price. We will reimburse using the same payment method you chose for the original transaction. We may withhold the refund until we have received the item back,

Uncollected packages/wrongly stated address
Packages remain at the pickup point for 7 days before being returned to us.

If you do not pick up the package and it is sent back to us, you will be charged the actual shipping costs for the return shipment. In the event of cancellation, these will be deducted from the amount you would otherwise receive back. If you want the package resent, you must pay any delivery costs.

If we get the shipment returned due to an unknown address, or because you have moved from the address, we charge return shipping in accordance with GLS' current prices. If you want the package resent, you must pay any delivery costs.

Privacy policy
We need the following information when you shop with us:

Address
Phone number
E-mail address

We register and pass on the personal data necessary to deliver the item to you.
GLS - We pass on name, address, email and phone number to GLS in order to deliver your package to you and provide you with information about the shipment.
Paymentgateway - They handle the payment solution with us. We therefore pass on your order number and your payment selections (please note that we do not have access to your card details!)
Klaviyo - If you sign up for our newsletter in the cart, we pass on your name and email address to Klaviyo. In this way, we can send you relevant newsletters.

The personal data is registered with CarLab.dk and stored for five years, after which the information is deleted. 
We also work with a number of other companies that store and process data. These companies process information solely on our behalf and may not use it for their own purposes. 

We only work with data processors in the EU or in countries that can provide your information with adequate protection. 

The data controller at CarLab.dk is Director Dan Henrik Amilon. 

You have the right to be informed about what information we process about you. 
If you believe that the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you ask us to. This may, for example, be the case if your data is no longer necessary in relation to the purpose for which we were to use it. When personal data is collected via our website, we ensure that it always happens with your explicit consent, so that you are informed exactly which information is collected and why.
The director and employees at CarLab.dk have access to the information registered about you.

We do not store customer information encrypted.
We do not transmit customer information encrypted.

Information provided to CarLab.dk is in no way disclosed or sold on to third parties, and we do not register any sensitive personal information.

Cookies
On CarLab.dk, cookies are used for the purpose of optimizing the website and its functionality, thereby making your visit as easy as possible for you. You can delete cookies from your computer at any time; how this is done depends on your browser.

Log statistics
We use log statistics on CarLab.dk, which means that a statistics system collects information that can provide a statistical picture of how many visitors we have, where they come from, and where on the website they leave, etc. Log statistics are used only for the purpose of optimizing CarLab.dk.

Business purchase terms
These terms apply to business purchases, B2B sales. Here you can read about the right of withdrawal and complaints. For information about shipping, delivery, general information and payment, see the consumer purchase terms.

Right of withdrawal
There is no right of withdrawal for products purchased on CarLab.dk. 

Warranty
There is a 1-year warranty on products purchased on CarLab.dk. You must file a complaint immediately and within 2 days after discovering the defect. 

We do not issue refunds in connection with a complaint, but we offer extended remedial assistance in the form of repair or similar, if justified. When purchasing on CarLab.dk, the buyer therefore waives the right to cancel in favor of the seller's extended duty to remedy.

In special cases, if CarLab.dk assesses that it is reasonable, the buyer may exercise the right to cancel. There may be a deduction for the value of use.

If CarLab.dk does not remedy the defect within a reasonable time, the buyer may cancel the agreement and receive a refund less the value of use.
